DALLAS -- The Woodburn man involved in a three-vehicle accident on Highway 22 in Polk County on Jan. 19 that killed one person and injured three others has been indicted on manslaughter and other charges.
A Polk County grand jury indicted Marcos Antonio-Luz, 41, on 10 counts Feb. 13: first-degree manslaughter, second-degree manslaughter, second-degree assault, third-degree assault, two counts of fourth-degree assault, driving under the influence of intoxicants, reckless driving, and two counts of reckless endangering.
Antonio-Luz was scheduled for a pretrial conference Tuesday after the Itemizer-Observer went to press.
The fatal crash occurred at 6:30 p.m. Jan. 19 on Highway 22 at milepost 6.5 near Red Prairie Road. According to court documents, Antonio-Luz was traveling west in a Ford van when he crossed the centerline and hit an eastbound Toyota sedan. A westbound Dodge pickup then hit Antonio-Luz's van, knocking it down an embankment.
The driver of the Toyota, Clifford Fagaly, 69, of Silverton died at the scene. His wife and passenger, Kerttu Fagaly, 85, was seriously injured in the accident.
The driver and passenger of the pickup sustained minor injuries.
Court documents said a blood test conducted at Salem Hospital following the accident indicated Antonio-Luz's blood alcohol level was .175.
